Can I get rid of my debts and keep my personal belongings, my car and/or my house?

Chapter 7 Bankruptcy generally can do this for most people unless you have equity in your home.  In other words, based on your best guess to the value of your home, if you did sell, would you get more than $20,000 at settlement? If so, you have equity. If you have too much equity, you may have to file a chapter 13 in order to keep your home.  Chapter 7 will get rid of credit cards and medical bills, but not student loans or some taxes.  Bankruptcy will generally improve your credit rating, and it will NOT ruin your security clearance. Any Bankruptcy will stop a lawsuit or Garnishment.

The bank is threatening or has scheduled a Foreclosure Sale of my house, can I stop it?

Chapter 13 Bankruptcy generally is your best bet. If filed before, it will cancel the Foreclosure Sale.  You will be required to pay the regular mortgage payment plus a monthly plan payment that will go towards the payments you were behind.  You continue paying any car payments and keep you car.  If you have other debts (credit card, medical or other), these are sometimes paid as a part of the monthly plan payment.  There are many different options, so call me for a free telephone consult at 703-257-1159 so we can discuss.

Please call me at 703-257-1159 to discuss. If you want to meet to discuss in more detail, I generally spend an hour discussing all options.  At the conclusion of the meeting, you will know what best for you, either filing or not filing a Bankruptcy.  Or, possibly taking actions now with a plan to file later.  I charge $400 for this 1 hour meeting, and if you decide to file, I will credit this $400 toward my fee to file a Bankruptcy.
